These Terms of Use (“Terms”) govern your access to and use of the MyMemoir mobile application and related website operated by Jason Liang, doing business as MyMemoir. By accessing or using MyMemoir, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use MyMemoir. By using the Service, you represent that you meet these requirements.

2. Description of Service

MyMemoir helps users record, transcribe, and generate personal memoirs using artificial intelligence. The Service may include temporary data processing on secure servers and integrations with third-party technologies such as OpenAI’s API.

3. User Accounts

MyMemoir currently does not require user accounts. Any data you submit or record is associated only with your device or temporary processing session. You are responsible for safeguarding your device and exported files.

4. Fees and Payments

Certain features of MyMemoir may require payment, including but not limited to a one-time purchase price for downloading the app or in-app purchases for premium features. All fees are displayed within the app or App Store listing and are subject to change. Payments are processed through Apple’s App Store or other authorized platforms and are subject to their terms. All sales are final except where required by law.

5. User Content and License

You retain ownership of all content, recordings, and other materials you submit through MyMemoir. By submitting content, you grant MyMemoir a perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, and sublicensable license to host, store, reproduce, modify, adapt, translate, distribute, and otherwise use your content for the purposes of operating and improving the service, developing new features, and internal analytics or testing. You waive any moral rights or rights of attribution to the extent permitted by law. While this license is broad for legal clarity, MyMemoir does not claim ownership of your personal stories and will never publicly share them without your explicit consent.

6. Data Handling and Storage

MyMemoir temporarily processes story text, recordings, and AI-generated drafts through secure AWS servers and OpenAI’s API to create your memoir. This data is not stored permanently. It may be retained briefly during processing and then deleted automatically or periodically purged. We do not sell, rent, or share your data with third parties.

7. AI-Generated Content Disclaimer

Some content in MyMemoir is generated automatically using artificial intelligence. Such text and suggestions may contain inaccuracies, omissions, or unintended content. MyMemoir does not guarantee factual accuracy or reliability of AI outputs. You are solely responsible for reviewing, editing, and deciding how to use any AI-generated content.

8. Acceptable Use

You agree not to use MyMemoir for unlawful, harmful, or defamatory purposes; attempt to reverse-engineer or copy any part of the Service; interfere with or disrupt its operation; or upload content that infringes on others’ rights. We may remove any content or suspend access for violations of these Terms.

9. Termination and Suspension

We may suspend or terminate your access to MyMemoir at any time, with or without notice, if we believe you have violated these Terms or engaged in harmful conduct. Upon termination, we may delete or retain your data at our discretion to comply with legal obligations or maintain service integrity.

10. Intellectual Property

All intellectual property in MyMemoir—including the app, design, code, trademarks, text, and graphics—is owned by or licensed to Jason Liang doing business as MyMemoir. You are granted a limited, non-transferable license to use the app for personal, non-commercial purposes.

11. Indemnification

You agree to indemnify, defend, and hold harmless MyMemoir, its affiliates, and their officers, employees, and contractors from any claims, damages, or liabilities arising from your use of the Service, your content, or your violation of these Terms.

12. Compliance with Laws

You agree to use MyMemoir only in compliance with all applicable laws, including export control regulations and local restrictions on AI technologies.

13. Force Majeure

MyMemoir is not responsible for any delay or failure to perform resulting from causes beyond its reasonable control, including natural disasters, war, internet outages, or third-party service interruptions.

14. DMCA / Copyright Complaints

If you believe that any content in MyMemoir infringes your copyright, please send a notice to team@mymemoirai.com with the subject “DMCA Notice.” Your notice must include the information required under 17 U.S.C. § 512(c)(3).

15. No Professional Advice

Content generated or provided through MyMemoir is for personal storytelling purposes only and should not be considered legal, medical, psychological, or professional advice.

16. Disclaimers and Limitation of Liability

MyMemoir is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, all warranties are disclaimed. We are not liable for any indirect, incidental, or consequential damages, including loss of data or profits. Your sole remedy for dissatisfaction with the Service is to stop using it.

17. Changes to These Terms

We may update these Terms from time to time. The latest version will be posted on mymemoirai.com/terms or within the app and becomes effective upon posting. Continued use after changes constitutes acceptance.

18. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.

19. Privacy Policy

Your use of MyMemoir is also governed by our Privacy Policy, available at mymemoirai.com/privacy.
